Please read these Terms and Conditions ("Terms") carefully before using ReadyTo.Vote ("the Service," "we," "us," or "our").

By creating an account or using this Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use this Service.

1. Description of Service

1.1 What We Do

ReadyTo.Vote is a technology platform that provides infrastructure to help eligible Texas residents submit voter registration applications. Specifically, we:

  • Provide a web-based interface for you to enter your voter registration information
  • Generate a Texas voter registration application form based on data you provide
  • Facilitate your use of Lob, Inc., a third-party commercial mailing service, to print and mail your application to your county voter registrar
  • Store a copy of your application in your account for your personal records
  • Provide tracking and status information about your mailing

1.2 What We Do NOT Do

We do NOT:

  • Act as Volunteer Deputy Registrars (VDRs) as defined by Texas Election Code
  • Receive completed voter registration applications from you for delivery to registrars
  • Review your application for accuracy, completeness, or eligibility
  • Exercise any discretion over whether or when to send your application
  • Guarantee that your application will be delivered or accepted by your county registrar
  • Register you to vote (only your county voter registrar can register you)
  • Provide legal advice regarding voter registration or eligibility

2. User Responsibilities and Representations

2.1 Eligibility and Self-Attestation

Before using this Service, you must confirm your eligibility by attesting to the following:

By using this Service, you represent, warrant, and attest that:

  • You are a United States citizen
  • You are a resident of the State of Texas
  • You are at least 17 years and 10 months old (and will be 18 years old by the next election)
  • You have not been finally convicted of a felony, OR if you have been convicted, you have fully discharged your sentence, including any incarceration, parole, supervision, period of probation, or you have been pardoned or otherwise released from the resulting disability to vote
  • You have not been determined by a final judgment of a court to be totally mentally incapacitated or partially mentally incapacitated without the right to vote
  • You meet all Texas voter registration eligibility requirements under Texas Election Code

You acknowledge and agree that:

  • These attestations are legally binding
  • Providing false attestations may constitute a criminal offense under state or federal law
  • We may report suspected false attestations to appropriate authorities
  • You will be solely responsible for any legal consequences of false attestations

2.2 Prohibition on Fraudulent Use

You explicitly agree that you will NOT:

  • Submit voter registration information for anyone other than yourself without their explicit authorization
  • Provide false, fictitious, or fraudulent information
  • Use someone else's identity or personal information
  • Submit multiple fraudulent applications
  • Use automated systems, bots, or scripts to submit applications
  • Attempt to register to vote if you are not eligible
  • Violate Texas Penal Code Section 13.007 (making a false statement on a voter registration application) or any other applicable law

Criminal Penalties:

You acknowledge that under Texas Penal Code Section 13.007, a person commits an offense if they knowingly or intentionally make a false statement on a voter registration application. This offense may be punishable as a state jail felony or Class A misdemeanor depending on circumstances.

2.3 Accuracy of Information

You represent and warrant that:

  • All information you provide is true, accurate, complete, and current
  • You have carefully reviewed your application before authorizing us to send it
  • You understand that providing false information on a voter registration application may violate state or federal law
  • YOU ARE SOLELY RESPONSIBLE FOR THE ACCURACY AND COMPLETENESS OF YOUR APPLICATION

2.4 Your Review Obligation

You acknowledge and agree that:

  • Our system provides automated format validation (e.g., checking that dates are valid, ZIP codes are 5 digits) but does NOT review your application for accuracy or completeness
  • No human reviews your application before it is sent
  • You must carefully review the generated application preview before authorizing mailing
  • You are responsible for ensuring all information is correct before submission

3. How the Service Works

3.1 The Process

When you use our Service:

  1. You provide data - You enter your personal information and create an electronic signature through our platform
  2. You review - We generate a preview of your voter registration application for you to review
  3. You authorize - You explicitly authorize us to transmit your information to Lob for printing and mailing
  4. We transmit - Our automated system immediately transmits your information to Lob's API
  5. Lob prints and mails - Lob prints your application and mails it via USPS to your county voter registrar
  6. We store a copy - After transmission to Lob, we save a copy of your application in your account for your records
  7. We provide tracking - We provide status information about your mailing

3.2 Immediate and Automated Processing

You acknowledge and agree that:

  • Once you click "Authorize Mailing," our system immediately and automatically transmits your information to Lob
  • There is no queue, delay, or holding period
  • No human reviews or approves your application
  • We have ZERO discretion over whether to send your application once you authorize it
  • We cannot stop or cancel the mailing once you have authorized it

3.3 Third-Party Mailing Service

You acknowledge and agree that:

  • Lob, Inc. (not us) physically prints and mails your voter registration application
  • You are authorizing Lob to mail your application on your behalf
  • We transmit your information to Lob's systems for this purpose
  • Lob is responsible for the printing and mailing
  • We are not the mailing service; we provide infrastructure that facilitates your use of Lob's mailing service

4. Legal Framework and Disclaimers

4.1 Not Acting as VDRs

We explicitly disclaim any role as Volunteer Deputy Registrars.

Under Texas Election Code Section 13.044, a person who receives a voter registration application from an applicant for the purpose of delivering it to the registrar must be appointed as a Volunteer Deputy Registrar.

We do not receive completed voter registration applications from you for delivery. Instead:

  • You provide us with data (not a completed application)
  • We generate a voter registration form based on your data
  • You authorize us to use a commercial mailing service to send it
  • Lob mails the application
  • We store a copy for your records after transmission

This process is fundamentally different from the VDR function contemplated by Texas law.

4.2 Document Generation, Not Document Receipt

You acknowledge and agree that:

  • You do not create a completed voter registration application and then give it to us
  • Instead, you provide data to our system, which generates the application
  • The application does not exist until our system creates it from your data
  • We are providing document generation and transmission infrastructure, not acting as a delivery intermediary for pre-existing applications

The Printer Analogy:

Just as a printer doesn't "complete" a document on your behalf when it prints words you typed in Microsoft Word, we don't "complete" your voter registration application on your behalf. We are technological infrastructure—similar to a printer combined with a mailing service—that you use to accomplish your goals. You create the content, you authorize and conduct the action, and you remain legally responsible for what is submitted.

4.3 Storage for User Benefit

You acknowledge and agree that:

  • We store a copy of your application in your account AFTER it has been transmitted to Lob
  • This storage is for your benefit (so you have a record of what you submitted)
  • This storage is not part of our mailing or delivery function
  • You can download or delete your application copy at any time
  • The copy in your account is your personal record, not a "held" application awaiting delivery

4.4 Legal Uncertainty and Risk Acknowledgment

You acknowledge and agree that:

  • This Service uses technology in a way that is relatively new for voter registration
  • Texas election law was written primarily for paper-based, in-person voter registration processes
  • There is legal uncertainty about how Texas law applies to automated digital voter registration services
  • We created this Service lawfully and hold ourselves to the highest standards of Texas law as it relates to voter registration, data security, and the privacy of PII, as of the date above; however, we acknowledge that Texas courts have not ruled on this specific type of service
  • BY USING THIS SERVICE, YOU ACCEPT ANY LEGAL RISKS ASSOCIATED WITH THIS UNCERTAINTY

5. No Guarantees

5.1 Delivery and Acceptance

We do NOT guarantee:

  • That your application will be successfully delivered to your county registrar
  • That your county registrar will accept your application
  • That you will be registered to vote
  • That the U.S. Postal Service will deliver your application
  • That Lob will successfully print and mail your application

5.2 Technical Issues

We are not liable for:

  • Technical failures of our platform
  • Failures of Lob's systems
  • Failures of USPS delivery
  • Internet connectivity issues
  • Data transmission errors

5.3 Registration Status

We cannot and do not verify your voter registration status.

To confirm you are registered to vote, you must contact your county voter registrar directly or check your registration status through official Texas Secretary of State resources.

6. User Accounts and Data

6.1 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

6.2 Data We Collect and Store

We collect and store:

  • Personal information you provide (name, address, date of birth, etc.)
  • Your electronic signature image
  • Records of when you authorized mailings
  • Copies of applications you submitted (stored in your account)
  • Tracking and delivery status information
  • Technical data about your use of the Service

6.3 How We Use Your Data

We use your data to:

  • Generate your voter registration application
  • Transmit your information to Lob for printing and mailing
  • Provide you with copies and records of your submissions
  • Track the status of your mailings
  • Send you reminders about voter registration renewals (if you opt in)
  • Improve our Service

We do NOT:

  • Sell your personal information
  • Use your data for political purposes beyond voter registration
  • Share your data except as necessary to provide the Service (e.g., with Lob) or as required by law

6.4 Data Retention

  • We retain your account data as long as your account is active
  • You may delete your account and data at any time
  • We may retain certain data as required by law or for legitimate business purposes

7. Fraud Prevention and Detection

7.1 Our Fraud Prevention Measures

To prevent misuse of our Service and protect the integrity of voter registration, we implement:

Technical Safeguards:

  • Email verification requirements
  • CAPTCHA protection against automated submissions
  • Rate limiting to prevent mass submissions from single sources
  • IP address logging and tracking
  • Automated pattern detection for suspicious activity
  • Device fingerprinting to identify unusual patterns

Accountability Measures:

  • User account system with verified email addresses
  • Timestamped records of all submissions and user actions
  • Electronic signature collection with legal accountability
  • Audit trails of all activities on the platform

Eligibility Verification:

  • Required self-attestation of eligibility before application
  • Clear warnings about criminal penalties for false information
  • User confirmation that all information is accurate

7.2 Monitoring and Investigation

We reserve the right to:

  • Monitor submissions for patterns indicative of fraud or abuse
  • Flag suspicious accounts or submissions for review
  • Temporarily suspend accounts pending investigation
  • Permanently terminate accounts engaged in fraudulent activity
  • Report suspected fraud to law enforcement and election officials
  • Cooperate fully with investigations by authorities
  • Preserve and provide records to law enforcement upon lawful request

7.3 Consequences of Fraudulent Use

If we determine you have used the Service fraudulently or in violation of these Terms:

  • Your account will be immediately terminated
  • We may report your activity to:
    • Your county voter registrar
    • The Texas Secretary of State
    • Local, state, or federal law enforcement
    • Other appropriate authorities
  • We will preserve all records related to your account and activity
  • We will cooperate with any investigation or prosecution

7.4 No Obligation to Monitor

While we implement fraud prevention measures, we have no obligation to monitor all user activity and cannot guarantee the prevention of all fraudulent submissions.

The ultimate responsibility for verifying voter eligibility rests with county voter registrars. Our fraud prevention measures are supplementary safeguards, not a replacement for official verification processes.

7.5 Reporting Fraud

If you believe someone has:

  • Submitted an application in your name without authorization
  • Used your personal information fraudulently
  • Engaged in fraudulent activity on our platform

Please immediately:

  1. Contact us at fraud@b-59.com
  2. Contact your county voter registrar
  3. Consider filing a police report

We take fraud reports seriously and will investigate promptly.

8. Prohibited Uses

You agree NOT to use this Service to:

  • Submit false or fraudulent voter registration information
  • Register someone else without their authorization
  • Submit multiple registration applications with false information
  • Attempt to manipulate, disrupt, or damage our systems
  • Violate any applicable laws or regulations
  • Use automated systems (bots, scrapers) to access the Service
  • Attempt to register to vote if you are not eligible

9. Intellectual Property

9.1 Our Property

The Service, including all software, design, text, graphics, and other content, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal purposes only.

9.3 Your Data

You retain all rights to the personal information you provide. By using the Service, you grant us a license to use your information solely to provide the Service as described in these Terms.

10. Limitation of Liability

10.1 To the Maximum Extent Permitted by Law:

WE ARE NOT LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or use
  • Failure to register to vote or voting-related damages
  • Damages arising from your use or inability to use the Service
  • Any damages arising from third-party actions (Lob, USPS, county registrars, etc.)
  • Legal consequences if authorities challenge the Service's legality

10.2 Maximum Liability

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us for the Service in the 12 months preceding the claim (or $100 if you paid nothing).

10.3 Essential Basis of Bargain

You acknowledge that these limitations of liability are an essential part of our agreement and that we would not provide the Service without these limitations.

11. Indemnification

You agree to indemnify, defend, and hold harmless ReadyTo.Vote, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Information you submit through the Service
  • Any claim that you were not eligible to register to vote
  • Any claim arising from the legal status of this Service

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties that your application will be delivered or accepted
  • Warranties regarding the legal status of the Service

13. Changes to Service and Terms

13.1 Changes to Service

We reserve the right to:

  • Modify or discontinue the Service at any time
  • Change features or functionality
  • Suspend or terminate the Service

13.2 Changes to Terms

We may update these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Updating the "Last Updated" date
  • Sending you an email (if you have an account)

Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Termination

14.1 Your Right to Terminate

You may stop using the Service and delete your account at any time.

14.2 Our Right to Terminate

We may suspend or terminate your access to the Service at any time if:

  • You violate these Terms
  • We believe you are using the Service fraudulently or illegally
  • We are required to do so by law
  • We decide to discontinue the Service

14.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and data (subject to legal retention requirements)
  • Applications already sent cannot be recalled
  • Provisions of these Terms that by their nature should survive (indemnification, limitation of liability, etc.) will survive

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

15.2 Venue

Any legal action arising from these Terms or the Service must be brought in the state or federal courts located in Texas. You consent to the exclusive jurisdiction of these courts.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights under them. We may assign these Terms to any successor or affiliate.

16.5 No Agency

These Terms do not create any agency, partnership, or joint venture between you and us.

17. Special Provisions for Texas Voter Registration

17.1 Texas-Specific Acknowledgments

You acknowledge and agree that:

  • Texas law requires a physical signature on voter registration applications
  • Texas does not currently offer fully online voter registration
  • This Service uses electronic signatures that are printed on physical forms
  • Texas Election Code governs voter registration requirements
  • Your county voter registrar has final authority over whether to accept your registration

17.2 No Legal Advice

Nothing in this Service constitutes legal advice about:

  • Whether you are eligible to vote
  • How Texas election law applies to your situation
  • Whether you should use this Service versus other registration methods

If you have legal questions, consult an attorney.

17.3 Alternative Registration Methods

You acknowledge that you have alternatives to using this Service, including:

  • Registering in person at your county voter registrar's office
  • Downloading and mailing a form yourself
  • Registering at various government offices (DPS, etc.)
  • Using other voter registration services

Acknowledgment and Acceptance

BY CLICKING "I AGREE" OR BY USING THIS SERVICE, YOU ACKNOWLEDGE THAT:

  1. You have read and understood these Terms
  2. You agree to be bound by these Terms
  3. You understand that we do not act as Volunteer Deputy Registrars
  4. You understand that Lob (not us) physically mails your application
  5. You are responsible for the accuracy of your information
  6. You accept the legal uncertainty regarding this type of service
  7. You accept all risks associated with using this Service
  8. You understand we make no guarantees about delivery or acceptance of your application

If you do not agree to these Terms, do not use this Service.
